
RISE REFORMER PILATES – TERMS AND CONDITIONS
By signing up for or participating in any classes, activities, or services provided by Rise Reformer Pilates, you agree to be bound by the Terms and Conditions outlined below. If you have any questions, please contact us at admin@risepilates.co.nz.
We reserve the right to modify, update, or replace these Terms and Conditions at any time. Any changes will be published on our website. By continuing to use our services after such changes are posted, you agree to be bound by the revised Terms and Conditions.
In these Terms and Conditions, references to “we”, “us”, and “our” refer to Rise Pilates Ltd, trading as Rise Reformer Pilates.
1. Medical Warning
Before starting any new exercise program, including those offered by Rise Reformer Pilates, we strongly recommend consulting your doctor or healthcare provider to ensure the program is suitable for your current health status and any conditions you may have.
During our classes, please listen to your body and work within your limits. Stop immediately if you experience pain or discomfort, and seek medical attention if you notice any unexpected changes in your physical condition.
You must inform your instructor of any pre-existing injuries or medical conditions that could affect your ability to participate safely in class activities.
By participating in any exercise program or using any equipment provided or purchased from us, you do so at your own risk. Rise Reformer Pilates, its instructors, employees, and agents will not be liable for any personal injury, loss, or damage arising directly or indirectly from your participation in our classes or use of our guidance or materials.
You must agree to our WAIVER OF LIABILITY AND PROSPECTIVE RELEASE FORM FOR RISE REFORMER PILATES prior to participating in any classes, excercises, or private appointments at Rise Reformer Pilates. Our waiver can be found at www.risepilates.co.nz/waiver.
2. Prices and Booking
Our current class prices and schedules are available on our website and app. Prices may be updated from time to time, and any changes will be published on our website. Price changes will not affect existing bookings or memberships within the minimum term.
To participate in classes, you must first create an account with us. Your account is subject to these Terms and Conditions and our Privacy Policy.
Class sizes are limited, so you must reserve your spot in advance. Bookings can be made through our website or app, and we recommend booking early to avoid missing out.
3. Cancellation Policy
We ask that all class cancellations be made at least 8 hours prior to the scheduled class start time. This allows us to offer the spot to others and helps keep classes accessible for everyone.
Late Cancellations (within 8 hours of the class start time) will result in:
• A $15 late cancellation fee, and
• Loss of the session used to book the class. For class pack holders, this means one class will be deducted from your pack. For members, it counts as one class used for the week.
No-Shows are treated as late cancellations and incur the same fee and session deduction.
This policy applies to all booking types, including memberships, class packs, and single class purchases.
You can cancel your class easily through our website or mobile app.
4. Class Waitlists
If a class is fully booked, you can join the waitlist. When a spot becomes available, we will notify you via email, and available spots will be offered on a first-come, first-served basis through our website and app. Please make sure your email notifications are enabled and check them regularly to secure your spot.
If you are no longer interested or available, please remove yourself from the waitlist through our website or app to avoid missing out on other participants.
5. Memberships & Class Packs
Our memberships provide flexible options to suit your Pilates practice needs:
• All memberships have a minimum commitment period and are billed in weekly or fortnightly instalments via direct debit.
• Memberships include a weekly class attendance limit (Monday to Sunday), with some options offering unlimited classes subject to fair usage.
• At the end of your minimum term, memberships automatically continue on a rolling weekly basis at the same rate and class limit.
• Discounted or VIP memberships may be offered occasionally with specific terms and conditions.
Class packs offer a flexible, pre-paid alternative:
• Class packs consist of a set number of individual classes to be used within a specified validity period.
• They are purchased upfront via our website or app and cannot be transferred, refunded, or extended beyond their expiry date.
All classes must be paid for in advance through one of the following methods:
• Membership booking
• Class pack usage
• Casual (single class) payment at the time of booking
Please note:
• Memberships and class packs are non-transferable and may not be sold, shared, or assigned to others.
• Unused classes within your weekly membership limit expire at the end of each week and do not carry over.
• Class packs have strict expiry dates; unused classes after expiry are forfeited with no refunds.
• All sales are final. We do not offer refunds, transfers, suspensions, or extensions for any reason, including illness, injury, or scheduling conflicts.
Current pricing, membership options, and class pack expiry details are available on our website and are subject to change.
6. Early Termination
All membership termination requests must be submitted in writing via our website or app and are subject to the terms of your membership agreement.
Before the end of your minimum term: You may request to end your membership early. If approved, an early termination fee will apply. This fee is 25% of the total remaining instalments from the date your request is processed to the end of your minimum term.
After your minimum term ends: You may cancel your membership by providing at least 14 days' written notice. Billing will continue during this notice period, and your membership will remain active until the notice period ends.
Please note:
• Termination requests are not backdated and take effect from the date they are received and confirmed by us.
• We reserve the right to decline termination requests that do not comply with these terms.
7. Membership Suspension
We understand that life happens — whether you're away for travel, recovering from illness, or simply need a short break. You can request to suspend your membership under the following terms:
• Suspensions are available for up to 4 consecutive weeks at a time.
• A suspension fee of $5 per week applies and will be debited as usual during the suspension period.
• Suspension requests must be submitted in writing via our website or app at least 3 days before the intended suspension start date.
• If your membership is within its minimum term, the minimum term will be extended by the length of your suspension.
• After the 4-week suspension limit, your membership will automatically resume and continue as normal.
• Suspensions are not available retroactively or for periods less than one full week.
• Memberships cannot be suspended if there are any outstanding payments or account issues.
Please note: We do not offer suspensions or extensions for class packs. Class packs remain subject to their standard expiry period.
8. Refunds Policy
We do not offer refunds on any purchases, including memberships, class packs, promotional offers, or VIP memberships — except where required by New Zealand consumer law (e.g., where services provided are faulty or not delivered as advertised).
This includes situations such as:
• Change of mind
• Injury or illness
• Relocation
• Scheduling conflicts
• Failure to attend classes
• Unused or partially used memberships or class packs
Memberships:
All memberships are non-refundable once purchased, including during the minimum term. If you wish to end your membership early, please refer to our Early Termination policy.
Class Packs:
All class pack sales are final. Class packs are non-refundable, non-transferable, and must be used within their set expiry period.
Promotional or VIP Memberships:
Discounted or limited-time promotional memberships (including VIP memberships) are also non-refundable and subject to their specific terms and conditions, as outlined at the time of purchase.
Please contact us if you believe your situation qualifies for a refund under the Consumer Guarantees Act. We will assess each request in line with our legal obligations.
9. Referral Credit
We may occasionally offer referral credit to existing members who introduce new clients to our studio. This credit can be applied toward the purchase of class packs or membership subscriptions but is not redeemable for cash.
Referral credits are offered at our discretion and may require the referred person to meet specific conditions (such as signing up for a membership or purchasing a class pack). Details of any referral promotions will be communicated at the time of the offer.
10. Gift Vouchers
We may offer gift vouchers for sale, or provide them as rewards, incentives, or part of promotional campaigns.
Gift vouchers are valid for the dollar value stated and are not redeemable for cash. They are non-refundable and non-transferable, and may not be returned, resold, or used for unauthorised advertising, marketing, competitions, or promotional activities.
All gift vouchers have a strict expiry date. Any unused balance after the expiry will be forfeited and cannot be refunded. We are not responsible for lost or stolen vouchers.
Gift vouchers may not be returned, resold, or used for any unauthorised marketing, advertising, sweepstakes, or promotional activities.
11. Class Schedule
Our class schedule is subject to change or cancellation without notice.
We are not liable to provide refunds, credits, transfers, or compensation for any classes that are changed, cancelled, or otherwise not held as scheduled.
We may adjust our opening hours at any time without prior notice. You will be informed of any permanent changes.
12. Conditions of Entry
We aim to maintain a safe, respectful, and enjoyable environment for all. Rise Reformer Pilates reserves the right to refuse entry or remove any person who is behaving in a disorderly, aggressive, intoxicated, offensive, or unsafe manner.
To ensure minimal disruption to classes:
• Please arrive at least 5 minutes before your class starts. Should you arrive more than 5 minutes after the class starts you will not be permitted to join the class. Your reformer may be given to someone on the waitlist if you are late.
• Leaving class early is strongly discouraged as it disrupts others.
Additional studio guidelines:
• Smoking is not permitted inside or directly outside the studio.
• Please treat all staff, clients, and property with respect and care.
• Wear appropriate exercise attire. Clothing with offensive designs or that poses a safety risk is not permitted.
• Grip socks must be worn during all classes. These are available for purchase at reception if needed.
• Set mobile phones to silent before class. If you are on-call for urgent matters (e.g., medical professionals), please inform the instructor in advance.
13. Personal Safety and Acceptance of Risk
By attending our studio and participating in Rise Reformer Pilates classes, you acknowledge that Pilates involves physical activity and exercise, which carries an inherent risk of personal injury. Participation in any class, service, or activity at the Studio is entirely at your own risk.
You must inform your instructor before class begins if you are experiencing any health concerns, such as:
• A pre-existing injury or illness
• Muscle soreness or discomfort
• Pregnancy
• Any condition that may affect your ability to safely participate
Participation with any such condition is done at your own risk.
Our instructors and staff are not medically trained and are not qualified to assess your physical condition or ability to participate without risk. If you have any doubt about your health or physical ability, we strongly advise seeking medical advice before participating.
By attending our classes, you agree that Rise Reformer Pilates, along with its owners, directors, employees, agents, and affiliates, is not liable for any loss, injury, damage, or expense you (or your next of kin) may suffer in connection with participation in our classes, activities, or services.
Please note that our instructors may use tactile cueing (light touch or adjustment) to help ensure correct form and safe movement. By participating, you consent to this method of instruction in accordance with our best practices. If you do not wish to consent to this method of instruction, please advise the instructor prior to the start of the class.
14. Pregnancy
We offer specialised Pre and Postnatal classes designed to support women during and after pregnancy.
Our Principles class is generally safe for women in their first trimester (up to 12 weeks), but we strongly recommend attending our Prenatal classes during the first and second trimesters for tailored support and safety. If you wish to continue exercising into your third trimester, please get in touch with us to discuss options such as private sessions or modified classes to best suit your needs.
Postnatal classes are available to support your recovery after childbirth. We recommend consulting with your healthcare provider to determine the appropriate time to start.
For the safety of all participants, we require all pregnant clients to provide medical clearance from a doctor or lead maternity carer before attending our Pre and Postnatal classes. This can be a signed note or form confirming you are cleared to participate in exercise.
Please contact us if you have any questions or concerns about attending classes during pregnancy.
15. Security
Rise Reformer Pilates is not responsible for the loss, theft, or damage of any personal belongings you bring into our Studio. To help keep your items safe, we recommend that you:
• Avoid bringing valuables such as mobile phones, jewellery, wallets, bags, or other personal devices unless absolutely necessary.
• Bring only essential items needed for your visit.
• Use the Studio’s storage facilities to store your belongings during your time here. Please note that items are stored at your own risk.
We appreciate your understanding and encourage you to take care of your personal belongings while visiting us.
16. Misuse of Memberships and Class Packs
Rise Reformer Pilates reserves the right, at its sole discretion, to suspend or terminate any membership or class pack if we suspect fraud, misuse, or abuse of our booking system or services. This includes, but is not limited to, sharing memberships, unauthorized transfers, or booking irregularities.
If your membership or class pack is suspended or terminated, any remaining balance or unused classes may be forfeited. We will notify you of any such action taken.
17. Special Promotions
Rise Reformer Pilates may offer special promotions from time to time. Details and terms of each promotion will be available in-studio, and on our website and app. Promotions are subject to specific terms and conditions and may not be combined with other offers unless stated otherwise.
Please check with the Studio or visit our website and app for the latest promotions.
18. Payment
It is your responsibility to ensure sufficient funds are available in your nominated bank account or credit card to cover the cost of any memberships, class packs, or other products purchased from Rise Reformer Pilates.
If a payment is declined for any reason, we reserve the right to retry the payment when sufficient funds become available. Should an auto-debit payment fail due to insufficient funds, our payment provider may charge a failed transaction fee, which will be passed on to you approximately 7 days after the failed payment.
You will be notified via email in the event of a declined payment or additional fees. Please note, we are not responsible for any additional fees your bank may charge related to payment processing.
Access to classes and services are automatically suspended until outstanding payments and fees are settled.
19. Communication
Rise Reformer Pilates will communicate important updates regarding your membership, bookings, class schedules, changes to terms and conditions, studio notices, and other service-related matters through one or more of the following channels:
• Email
• SMS text message
• The Rise Reformer Pilates app
• Our official website
• In-studio notices
It is your responsibility to ensure that your contact details, including your email address and phone number, are accurate and up to date in your client account. We are not responsible for missed communications resulting from incorrect or outdated contact information.
We may also send you marketing communications, including updates about new classes, promotions, and special offers. You can opt out of receiving these communications during account setup or through your profile settings at any time.
If you no longer wish to receive marketing communications, you may opt out at any time by using the unsubscribe link in our emails or by updating your preferences through our app or website.
By using our services, you consent to receive essential service-related communications and, where opted in, marketing content in accordance with this policy.
20. Privacy
We respect your privacy and are committed to handling your personal information in accordance with the New Zealand Privacy Act 2020.
What We Collect:
We may collect personal information including your name, contact details, payment information, class attendance history, and any health information you voluntarily provide (e.g., injuries, pregnancy, medical conditions relevant to your safety in class).
How We Use Your Information:
Your data is used to:
• Manage bookings and class attendance
• Process payments and manage your membership
• Communicate with you about your account, our services, promotions, or important updates
• Ensure your health and safety in our classes
Who We Share It With:
We only share your information with trusted third parties necessary to deliver our services — such as:
• Payment processing providers
• Booking software providers
• Government agencies if required by law
We do not sell or rent your personal information to any third parties.
How We Store Your Data:
Your information is stored securely using encrypted systems and password-protected platforms. We retain your information only as long as necessary to fulfil our services or meet legal obligations.
Your Rights:
You have the right to:
• Request access to the personal information we hold about you
• Request corrections to inaccurate or outdated information
• Request deletion of your data (subject to legal or administrative retention requirements)

21. Intellectual Property
All content, materials, and branding provided by Rise Reformer Pilates — including but not limited to our logos, class formats, training programs, videos, written content, website, and promotional materials — are the intellectual property of Rise Reformer Pilates and are protected under copyright and other applicable laws.
By using our services, you agree not to reproduce, distribute, share, record, or otherwise use any of our intellectual property for commercial or personal purposes without our prior written consent.
Photography or video recording during classes is not permitted without express permission from Rise Reformer Pilates. Members may take photos before or after class, but must be respectful of other clients and staff and ensure no one is filmed or photographed without their consent, and that no intellectual property rights are infringed.
Unauthorised use of our intellectual property or inappropriate use of photo/video content may result in legal action and/or termination of your membership.
22. Limitation of Liability
Except for any liability that cannot be excluded by law, Rise Reformer Pilates (including its officers, employees, and agents) excludes all liability for any personal injury, loss, or damage of any kind (including but not limited to loss of opportunity, reputation, goodwill, privacy, or data), whether direct, indirect, special, or consequential, arising out of or in connection with your attendance at our classes or use of our services.
This exclusion includes, without limitation, any loss or damage resulting from theft, unauthorized access, or interference by third parties.
This limitation of liability applies even if Rise Reformer Pilates has been expressly advised of the potential loss.
By attending our classes, you accept this limitation of liability to the fullest extent permitted by law. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence.
23. Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the laws of New Zealand. You irrevocably submit to the non-exclusive jurisdiction of the courts of New Zealand, including any courts that may hear appeals from those courts, in respect of any proceedings arising out of or in connection with these Terms and Conditions.
24. Force Majeure
Rise Reformer Pilates is not liable for any delay, interruption, or failure to provide services where such delay or failure is due to events beyond our reasonable control. These events may include but are not limited to:
• Natural disasters (e.g., earthquakes, floods, storms)
• Fire, explosion, or public utility failure
• Pandemic or epidemic outbreaks (other than COVID-19, which is covered separately)
• Government mandates, lockdowns, or public health restrictions
• War, civil unrest, terrorism, or strikes
• Power outages or communication/network failures
• Unavailability of instructors due to illness or emergency
In such events, we reserve the right to cancel or reschedule classes, modify our services, or temporarily suspend operations without offering refunds or compensation, unless otherwise required by law.
We will make reasonable efforts to inform clients of any such disruptions and to resume normal operations as soon as practicable.
25. Coronavirus (COVID-19)
The health and safety of our clients and staff at Rise Reformer Pilates is our highest priority. We closely monitor updates from the New Zealand Government and follow guidance from the Ministry of Health to maintain a safe environment at our Studio.
If you are unable to attend classes due to government-mandated COVID-19 restrictions (including border closures, lockdowns, or vaccine mandates), no refunds will be issued. However, you may retain your remaining class credit on file, which will remain valid for 24 months from the original purchase date and can be applied towards memberships, class packs, or casual bookings.
We encourage all clients to stay home if feeling unwell or displaying any symptoms of illness and to notify us promptly if you are unable to attend a booked class due to COVID-19 related reasons.
Please note that this policy is subject to change in line with evolving government guidelines.
26. Severability
If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of law, that provision will be severed from these Terms, and the remaining provisions will continue in full force and effect.
